Dear Sir:

Thank you for your letter of 2 April in which you advised that `[My]
request hereby denied[sic] in as much as the University of Illinois at
Urbana-Champaign does not have access to such documentation.'

I am afraid I must advise that this statement is inaccurate.  As you will
have noticed, I also addressed my request to the chair of the Student
Election Committee, Mr Joel Baise.  On 12 March, Mr Baise advised me by
e-mail of the availability of the records to which I sought access, and
on 14 March, I obtained from the ISG office the information I desired.
Please find enclosed for your reference a copy of the election results
which I obtained.  I specifically call your attention to the URL at the
bottom of each page of the election results document indicating that
it was stored on a University worldwide web server and thus under the
purview of the University.

Given the discrepancy between your response and fact, it seems that
a communication problem exists between the offices of the University
which hold records which can be requested pursuant to the Freedom of
Information Act and the office which issues responses to those requests.
While I was in this case, at length, able to obtain the information I
requested, I pray that you will take measures to ensure that errors
such as the one I have described do not happen again in a manner by
which they could cause unlawful denials of requests made under the Act.
Further, I remind you that such errors would entitle those persons
whose requests were unlawfully denied to a right of action against the
University pursant to 5 ILCS 140/11.
